Booking Terms and Conditions

Your contract is with Downstream Enterprises, LLC, a Vermont limited liability company. These Terms and Conditions will apply to any reservations booked through Downstream Enterprises.

The person making the reservation and signing the Rental Agreement is referred to as the “Guest”. The Guest must be 25 years of age or older unless noted on the listing description. The guest is responsible for advising all occupants in their party of the Terms and Conditions in this document. At the time of reservation, the Guest accepts full responsibility for the actions of all other occupants in their party.

CONDITION AND USE OF THE PROPERTY


Upon occupancy of the Property, and during the term of the rental, the Guest shall promptly notify Downstream Enterprises of any non-functioning appliances, fixtures, or utilities. Downstream Enterprises shall not be responsible for any damage caused by utility malfunctions but will use its best efforts to correct any reported issues as quickly as possible.

All Guests agree to act in a responsible and respectful manner toward other guests and neighbors of adjoining properties. If at any time during the stay a guest acts in an unruly or malicious manner with verbal or physical abuse, this will result in immediate termination of the rental and forfeiture of all monies paid.

No parties, catering or outside music permitted without prior consent. The under-age consumption of alcohol or drugs by Guests, or driving while intoxicated or any accident involving intoxication of Guests shall not be the responsibility of Downstream Enterprises or Property owner. Guest shall comply with all rules, regulations, and other requirements of any community association or other covenants, conditions, and restrictions that are applicable to the Property.

An agent of Downstream Enterprises may enter the premises at any time in the event of emergency, but will use its best efforts to give 24-hour notice for normal maintenance.

Downstream Enterprises reserves the right to refuse or cancel, without penalty, the reservation of any guest who has previously breached the Downstream Enterprises Terms and Conditions.

RESERVATION REQUIREMENTS

50% of the total rental amount is due at time of booking ($500 of which is non-refundable deposit). Rental rates are subject to change and reservations are not considered confirmed until Downstream Enterprises has received payment. No grace period will apply. Final payment, consisting of the remaining balance, must be received by Downstream Enterprises at least sixty (60) days prior to guest arrival (or immediately if booked less than sixty (60) days in advance of guest arrival). Failure to make final payments on a timely basis will make reservation subject to automatic cancelation.

FEES AND TAXES

Vacation property rentals are subject to the state of Vermont rooms and meals tax of 9%. A fee of $35.00 will be charged for all returned checks. A cleaning fee, variable per property is applicable to all reservations. 

CANCELLATION

Cancellations must be received no later than 60 days prior to the Guest’s scheduled arrival in order for Guest to avoid being charged the remainder of the booking fee (i.e., the full fee minus the non-refundable deposit). Cancellations received within sixty (60) days prior to the Guest’s scheduled arrival may result in forfeiture of the entire booking fee if Owner is not able to rent the property to a replacement guest for the entire period covered by Guest’s reservation at the same rate. There will be no refunds for early departures or late arrival.

Reservations canceled after initial confirmation will forfeit any and all deposits or must abide by the booking site’s cancellation policy with which the reservation was made. 

COVID-19 EXTENUATING CIRCUMSTANCES

If you are uncomfortable with your capability to comply with any mandates or requirements that are still in place at the time of your reservation, we will consider amendments or refunds on a case-by-case basis. Federal, State, or locally enforced travel or lodging restrictions that are enacted between the time of your reservation and the beginning of your stay may also be considered extenuating circumstances regarding our booking and cancellation policies. Reservations canceled after initial confirmation will forfeit any and all deposits or must abide by the booking site’s cancellation policy with which the reservation was made.

CHECK-IN/CHECK-OUT: Check-in after 3:00 p.m. / Check-out by 11:00 a.m. No early arrivals or late departures are permitted without prior authorization by Owner. Check out must be complete prior to 11:00 a.m. on departure day in order for us to clean the property for the next guest.

NUMBER OF OCCUPANTS

The number of occupants cannot exceed the maximum number of occupants described for each property without prior arrangements. Infants and children are considered occupants and as such will be included in the count.

UNAVAILABILITY OF PROPERTY

In the event that the confirmed Property is not available due to circumstances beyond the control of Downstream Enterprises, the guest shall not hold Downstream Enterprises liable. If comparable accommodations are not available, the guest will receive a full refund.

DEPARTURE CLEANING

A standard cleaning fee which varies by property has been added to each rental agreement. Guest agrees to care for and use the premises in a clean and sanitary manner and to dispose of all garbage in trash bins provided. Guest shall use all systems, plumbing, appliances, and fixtures properly in accordance with their intended purposes keeping them in a clean condition, and the Guest shall be liable for any expense of cleaning, repair, or replacement from failure to observe this obligation. Properties are inspected after every stay and guests are responsible for leaving the property reasonably clean and orderly at departure. At its sole discretion, Downstream Enterprises reserves the right to charge additional cleaning fees if this requirement is not met.

PET POLICY

Pets are only permitted with prior approval at properties identified as “pets considered”. 

If housekeeping notes that a pet was present on a non-pet friendly property during your visit you will be charged an additional $200.

Adult dogs only. Your pet must be at least one year old and housebroken.

We ask you to be respectful of nearby neighbors. As a rule, please remember to have your dog on a leash where appropriate and not to leave them unattended for any length of time.

You agree to pick up after your pet and dispose of waste properly.

Pet damage must be reported DURING your stay so we can promptly schedule repairs. If your pet causes damage which would include scratches to wood furnishings and doors, you agree to pay for repairs. Pet damage is not considered accidental and as such is NOT covered by the damage protection plan. Guests are fully responsible for repairs for damage to the Property.

Due to insurance restrictions we are not able to allow certain dog breeds into rentals. Guest is responsible for reporting breed, size and age of dog. 

LEFT AND/OR STOLEN ITEMS – Downstream Enterprises is not responsible for any personal item(s) left in the home or any personal item(s) that are stolen during tenants stay.  If Downstream is able to recover any personal items left in the home, the guest may choose to have Downstream Enterprises ship the item(s) to the guest at the guest’s expense. 

MAINTENANCE ISSUES – Maintenance problems in the home will be handled in a professional manner. The rental rate will not be adjusted due to any malfunction of equipment, which includes but is not limited to TV’s, VCR’s, DVD players, satellite or cable TV, air conditioning units, hot water heaters, stoves, refrigerators, door locks, and hot tubs.

HOT TUB/SPA USE – There are certain health risks associated with a hot tub/spa and it is to be used at your own risk. Guests will hold harmless and indemnify Downstream Enterprises, and the Home or property owner against any and all claims and actions arising out of the use of the hot tub/spa, including, without limitation, expenses, judgments, fines, settlements and other amounts actually and reasonably incurred in connection with any liability, suit, action, loss, or damages arising or resulting from the Guest use of the hot tub/spa. Guest acknowledges that use of amenities, including but not limited to hot tub/spas, pools, fireplaces, decks, and the like may be potentially dangerous and involve potential risks if improperly used, particularly with regard to children, and such use is at the Guest’s own risk.

DO NOT STAND ON THE HOT TUB COVERS. Hot tub covers are for insulation purposes and are not designed to support a person or persons. When not using the hot tub please leave the cover on so the hot tub will stay warm. Properties with hot tubs are serviced and cleaned on a regular basis by a professional service independent of the property owner or Downstream Enterprises. While every effort has been made to ensure that the water quality is clean and meets all recommended health standards, neither Downstream Enterprises or the property owner can guarantee the use of the spa will not have an adverse effect on the person entering the tub. 

SUPPLIES: Owner provides a STARTER PACK of toilet paper, paper towels, and toiletries (shampoo, conditioner, body wash, facial wipes) for every reservation. For longer stays or larger groups Owner recommends purchasing additional items at local stores, as needed. The home will have freshly laundered linens, pillows, and bath towels upon arrival.

RISK OF LOSS AND INDEMNIFICATION

By accepting this reservation, Guest agrees that all personal property, furnishings, personal affects and other items brought into the property by guest or their permitted guests and visitors shall be at the sole risk of guest with regard to any theft, damage, destruction, or other loss, and Downstream Enterprises shall not be responsible or liable for the above for any reason whatsoever.

Guest hereby covenants and agrees to indemnify and hold harmless Downstream Enterprises and its owners from and against any claims, damages, liabilities, costs, and attorney’s fees due to any claims relating to destruction of property, injury to persons, and/or loss of life sustained by guest, or family and visitors of guest, in or about the property. This shall equally apply to all actions, claims, damages, liabilities, costs, and attorney’s fees incurred by Guest, permitted guests, visitors, agents of Guest, representatives of Guest, or successors of Guest. Guest expressly agrees to save and hold Downstream Enterprises and its owners harmless in all such cases. Guest, jointly and severally for themselves, their permitted guests, invitees, licensees, or other persons that they may allow upon the Property, and the heirs, successors and personal representatives of such parties, agree to assume and accept any and all risk of injury, death, or property damage that may occur on the Property.

Travel to mountain areas, including but not limited to outdoor activities, at any time of year involve risks about which the Guests must make themselves aware. Guests will hold harmless and indemnify Downstream Enterprises and the Property owner against any and all claims and actions arising out of activities that they participate in during their stay, and all risks associated with the possibility of slippery conditions, falling snow and ice, freezing or high temperatures at all times inside and outside of the Property.
